So the California Supreme Court just ruled on prop 8 banning gay marriage. They upheld the referendum which means there is still a ban on same-sex unions, but the did not make it retroactive, which means there are 18000 same-sex couples in the state who are still married. I don't see how this situation is fair or makes any legal sense whatsoever, and I hope it gets resolved quickly.

The ruling in California makes me very sad but looking from a political point of view, the courts had it right. The California Supreme Court wasn't voting on whether same-sex couples had the right to marry, but whether Prop. 8 was a amendment to the constitution or a revision. If it was a revision then it would need to be voted on by the legislators. Sadly, the Court decided it was an amendment and as such the voters have the right to amend their constitution which means it stays.
This isn't the end though! Already, activist groups are working to go back to voters as early as next year in a bid to repeal Prop. 8.

This is completely FUCKED UP especially since Arnold could have signed it into existance a couple years ago, but he's too big of a pussy to take whatever heat that would have came from it. It's amazing to me that California is so far behind the times, while other states are passing legislation for same sex couples more easily, and a lot faster. It's also the religious mother fuckers with the bottomless pockets full of cash that keep promoting all the hate, and spewing all the lies. It's absolutely amazing how blind some people are. So now we all ready have the HRC and the Marriage Equality people with thier hands out for cash so they can make more stupid commercials, and hire more "grass roots" people to HOPEFULLY get something in the works to be voted on in 2010 or 2012. And you know those religious mother fuckers are there right along side them raising funds, to spew hate and lie. As Susan Powers used to say "Stop the Insanity!" FUCK!:2cents:

I must add though that it was nice of the high courts to let the people who did get married in the window of time that same sex marriages were legal to remain married. So maybe the next time around there will be more support, and more people getting married, to where eventually it wont make a difference:2cents: There's two more cents for you...LOL

If you'd been there, as I am, for the vote you wouldn't have been surprised at all. The mormons paid a boatload to try and shove this through, but the blacks were spewing more crap about it than anyone, AND they were doing it at the poling place which is not allowed. And what got me is that none of the black men there were married. Yes, the 5 men in line were towing more than a few toddlers there with them, which was annoying as they were bashing into us all as we stood in line, but it also shows their values. Bastard children out of wedlock are A-OK. Stopping same sex couples from marriage is also, A-OK.
How the hell can THEY be the judge of marriage when they seem to rarely try it on for size!
And, despite a plaque saying it was illegal to illegal to espouse a political opinion, many were standing in line shouting to vote for Prop 8! I even pointed this out to one of the people inside and they merely glared. Serves me right for expecting fairness when the polling place is a Baptist Church, right?

And here we go. Thanks for showing your colors. "Their" values? So all of us blacks share the same brain? We can't be individuals like everyone else? This decision didn't have a negative effect on gay blacks? I'm a bi-sexual, black, agnostic, who donated money to the no on 8 campaign. I guess I hold the same values as the people who voted yes on 8, solely based on my skin color.
P.S. How do you know that they weren't married? Did they mention it in some way? Just because they had kids with them doesn't indicate anything about their martial status.

Correct me if I'm wrong, but isn't it the case that civil unions are still legal in CA, and therefore same-sex couples can get all the tax breaks, etc., that hetero couples can, despite not being married?

Its true that there are civil unions but there are over 1,000 rights that married hetero couples get that people in civil unions don't. It's not the same. Separate is not equal.

One of the main ones that comes to mind right away is the death benifits. Say you have a straight couple and one of them dies the other one auto matically inherits everything, the house, half the other persons social security, everything right away. To where gay people have to spend thousands and thousand of dollars on lawyers to make sure all thier assets go to thier partner in case of death. And then they aren't eligible to recieve half of thier partners social security. That's just one example. Tax breaks as married couple is another. With a civil union they are still 2 individual people when it comes to taxes and child tax credits.
I think I have an email somewhere that mentions all the benifits I'll take a look around and see if I can find it.

the issue has not be laid to rest.. From what I heard there are lawyers that are fighting the issue of even putting the ban on as a vote.
Lawyers are saying "said that gays and lesbians who cannot marry were made into second-class citizens by California's voter-approved ban, known as Proposition 8, in violation of the U.S. Constitution."

That is what confuses me in regard to this whole thing. By the standard just upheld, we could just as easily ban inter-racial marriage under the same grounds. *Immoral, disgusting, unnatural*. Hopefully they get this tacked down before we begin taking steps backwards and repealing civil rights.
